RE: RATES AND/OR FORMS UPDATE - Montana Forms Filing Effective 8-11-25

Dear Associates: 

Stewart Title Guaranty Company has filed the following forms with the Montana Division of Insurance that are available for use effective August 11, 2025.

ALTA Endorsement 3.3 Zoning - Completed Improvement - Legal Non-Conforming Use (04-02-2024) - Designed for issuance on Land improved with an existing building where there is a known non-conforming use. It insures against loss or damage if a specific non-conforming use is not allowed because it violates a municipal or county zoning ordinance or regulation.

ALTA Endorsement 10.2 - Collateral Assignments (04-02-2024) - Provides insurance to the collateral assignee that the assignment of mortgage is valid and hasn’t been improperly modified, released, or discharged. It insures the lender’s security interest in the mortgage and protects against potential losses due to errors or unauthorized actions related to the mortgage assignment.

ALTA Endorsement 10.3 - Collateral Assignments and Date Down (04-02-2024) - Provides the same insurance as the ALTA 10.2 endorsement but with a date down of title.

ALTA Endorsement 18.3 Single Tax Parcel and ID - Provides insurance against loss if the Land is taxed as a part of a larger parcel; if the Land fails to constitute a separate tax parcel for real estate taxes; or if any portion of the Land is not being assessed under the specified tax ID number.

ALTA Endorsement 28 Damage or Enforced Removal (04-02-2025) - Insures against loss or damage by Insured if the exercise of a granted or reserved right to use or maintain an easement results in damage to an existing building or enforced removal of an existing building on the Land.

ALTA Endorsement 36.9 - Energy Project - Minerals and other Subsurface Substances - Land Under Development (01-02-2025) - Designed specifically for energy projects and is modeled on coverage similar to the ALTA 35.3 and ALTA 36 endorsements. The ALTA 36.9 contains an expansive definition of Electric Facility and contains a definition of existing and future Severable Improvements.

ALTA Endorsement 42 - Commercial Lender Group (05-02-2024) - Designed for commercial transactions where multiple lenders (Lender Group) share in a single loan. It protects the Lender Group against losses caused by the invalidity, unenforceability, or loss of priority of the Insured Mortgage due to the transfer of portions of the loan by the participating lenders.

ALTA Endorsement 48 - Tribal Waivers and Consents Endorsement (01-10-2025) and ALTA Endorsement 48.1 - Tribal Limited Waiver and Consent Agreement (01-02-2025) - Used as an endorsement to policies issued to a Tribe or Entity in which the Tribe has an ownership interest. The Entity/Tribe agrees to waive sovereign immunity, waive defense of failure to exhaust remedies in the courts of the Tribe, jurisdiction of federal courts or courts of the state where the Land is located and venue in the federal courts or courts of the state where the Land is located.

CLTA 150 Solar Endorsement (08-04-2022) - Designed to protect a lender’s lien against potential issues arising from the existence of a solar energy system on a property. It insures the solar lease does not invalidate or make unenforceable the lender’s mortgage.

STG Homeowner's Inflation Protection Endorsement - Provides for an increase in the amount of insurance by reason of inflation, with the increase not exceeding 50% of the amount of insurance.

STG Gap Coverage - Insures against matters recorded subsequent to closing and prior to the recording.

ALTA Short Form Expanded Coverage Residential Loan Policy - Assessments Priority 04-02-2024 - A condensed version of the ALTA Expanded Coverage Residential Loan Policy providing a concise and streamlined format for lenders on residential properties. It includes the automatic incorporation of certain endorsements and offers coverage similar to a homeowner’s title insurance policy. This version focuses on insuring the priority of the Insured Mortgage over liens for homeowners’ association assessments.

ALTA Short Form Expanded Coverage Residential Loan Policy - Current Assessments 04-02-2024 - Same as the ALTA Short Form Expanded Coverage Residential Loan Policy - Assessments Priority 04-02-2024 above, except this version focuses on coverage relating to unpaid homeowners' association assessments and it addresses potential losses from the enforcement of private rights.

These forms have been provided to third-party title production system (TPS) vendors. Please contact your TPS vendor or account services representative to have the new/revised forms implemented in your system.
